Alternative Dispute Resolution
1) Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Bernadette Langhans, operator of the online store PLR Business World (hereinafter "Entrepreneur"), apply to all contracts for the provision of digital products (digital content) concluded between a consumer or entrepreneur (hereinafter "Customer") and the Entrepreneur. The inclusion of the Customer's own terms and conditions is hereby excluded unless expressly agreed otherwise.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.
1.4 The store offers digital products worldwide. The PLR franchise system and the affiliate program are subject to the terms of the franchise provider.
2) Conclusion of Contract
2.1 The content described in the Entrepreneur's online store does not constitute binding offers but serves as an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit an offer via the online order form. After selecting the products and completing the ordering process, the Customer submits a legally binding offer by clicking the order button.
2.3 The Entrepreneur can accept the Customer's offer within five days by:

Sending an order confirmation,

Providing the ordered content, or

Requesting payment from the Customer.
If multiple of these alternatives occur, the contract is concluded at the time the first alternative occurs. If the offer is not accepted within the deadline, it is considered rejected.
2.4 Payment for the purchased goods is only possible via PayPal, credit and debit card, or Stripe.
2.5 The contract text is stored after the conclusion of the contract and sent to the Customer by email.
2.6 The contract language is exclusively German.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal. However, this expires for digital content as soon as the Customer has expressly agreed that the execution of the contract begins before the withdrawal period expires.
3.2 The Customer confirms their awareness of the loss of the right of withdrawal by ticking the corresponding checkbox during the ordering process.
4) Prices and Payment Terms
4.1 All prices are total prices and include statutory VAT.
4.2 Additional costs, such as exchange rate fees, may arise for payments from abroad and must be borne by the Customer.
4.3 The following payment methods are accepted:

5) Provision of Content
5.1 Digital products are provided via email as a download link within 12 hours after payment has been received.
5.2 The Customer is responsible for providing a correct email address and ensuring its receipt.
6) Granting of Usage Rights
6.1 The Customer receives a non-exclusive, unlimited right to use the acquired content for private and commercial purposes.
6.2 The Customer may resell, gift, modify, or distribute the acquired content as their own work.
6.3 Special usage rights apply to the PLR franchise, which are regulated in the franchise terms.
7) Liability for Defects
The statutory liability for defects applies.
8) Special Conditions for Digital Content
Custom modifications are only made by express agreement.
9) Applicable Law
The law of Miami, USA, applies. For consumers, this applies only insofar as mandatory legal provisions of their country of residence do not conflict.
10) Disclaimer of Liability
10.1 The Entrepreneur assumes no liability for the accuracy of the content of the e-books.
10.2 The Entrepreneur is only liable for damages in cases of intent or gross negligence.
11) Data Protection
Information on the handling of personal data can be found in the privacy policy on the website.
12) Code of Conduct
The Entrepreneur is committed to fair business practices.
13) Alternative Dispute Resolution
13.1 The EU Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr
13.2 The Entrepreneur is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
